Acceptance of Terms

By accessing and using Molted Cloud, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Description of Service

Molted Cloud provides a managed hosting platform for deploying and running AI assistant instances in Docker containers on our Kubernetes infrastructure. Our service includes instance management, automatic scaling, monitoring, and billing.

Account Registration

You agree to provide accurate, current, and complete information during the registration process and maintain the security of your account credentials. You are responsible for all activity under your account. You agree to notify us immediately of any unauthorized use of your account.

  • You must be at least 18 years old to use our service
  • You are responsible for maintaining account confidentiality
  • You agree to accept responsibility for all activities under your account
  • You agree to provide valid payment information for billing

API Keys and Third-Party Services

You are solely responsible for managing and securing your API keys. Molted Cloud encrypts API keys at rest, but you must keep your account credentials confidential. You agree that Molted Cloud is not responsible for any unauthorized use of your API keys.

  • API keys are your responsibility to manage and rotate
  • Do not share your account credentials with others
  • Notify us immediately of any suspected unauthorized access
  • You agree to pay for all usage through your connected API accounts

Acceptable Use Policy

You agree not to use our service for any unlawful purposes or in any way that violates these terms or applicable laws and regulations.

  • No illegal activities, harassment, or threats
  • No spam, malware, or security violations
  • No reverse engineering or unauthorized access attempts
  • No excessive resource consumption affecting other users
  • No reselling or unauthorized redistribution of service
  • No content that violates intellectual property rights

Payment, Billing, and Refund Policy

You agree to pay all charges and fees incurred by your account at the rates in effect when the charges are incurred. Billing occurs automatically each month on the anniversary of your subscription start date. All payments are final and non-refundable except as described below.

  • Charges are billed in USD unless otherwise specified
  • We reserve the right to change pricing with 30 days notice

Free Trial

We offer a 24-hour free trial so you can evaluate our service before committing to a paid subscription. This trial period is your opportunity to test the platform and decide whether you want to continue. Once the trial expires, your subscription automatically begins and you will be charged.

  • The free trial lasts exactly 24 hours from activation
  • You must cancel before the trial ends to avoid being charged
  • If you forget to cancel and are charged, no refund will be issued — the trial period was your evaluation window
  • It is your sole responsibility to track the trial expiration and cancel in time
  • No exceptions will be made for forgotten cancellations, timezone confusion, or technical issues on your end

Scope of Service and Our Obligations

Molted Cloud provides managed hosting infrastructure for open-source AI assistants. Our obligation is to ensure your instance is deployed, accessible, and running on our infrastructure. If we fail to deliver on this obligation, you are entitled to a refund. However, we do not provide support for configuring third-party services, API providers, or the underlying open-source software itself.

  • We host and maintain the infrastructure — uptime, deployment, networking, and storage
  • If our infrastructure fails to deliver the service as described (your instance cannot be deployed or is inaccessible due to our fault), you are entitled to a prorated refund for the affected period
  • We do not configure your AI providers (Anthropic, OpenAI, etc.) for you — that is your responsibility
  • We do not troubleshoot API key errors, rate limits, or billing issues with third-party providers
  • We do not teach you how to use the open-source software we host — documentation is available from the upstream project
  • If you cannot configure your instance, cannot get it to do what you want, or are unsatisfied with the capabilities of the open-source software, that is not grounds for a refund
  • Think of it like buying a musical instrument — the store is not obligated to refund you because you cannot play it

Refund Conditions

Refunds are only issued when Molted Cloud fails to deliver on its obligations as described in the Scope of Service section above. All other circumstances are non-refundable.

  • A verified, sustained service outage lasting more than 72 consecutive hours that is entirely attributable to our infrastructure (not third-party providers, not your configuration) entitles you to a prorated refund
  • A billing error on our end where you were charged an incorrect amount will be corrected via credit or refund of the difference
  • Where required by applicable consumer protection law in your jurisdiction
  • No refund will be issued for cancelled subscriptions — cancellation stops future charges but does not entitle you to a refund for the current billing period
  • No partial refunds for unused days within a billing period
  • Downgrading to a lower plan does not entitle you to a refund of the price difference
  • Any refund request must be made within 7 days of the charge — requests after this window will be automatically denied

Abuse, Misuse, and Forced Termination

We reserve the right to suspend or permanently terminate any account that we determine, at our sole discretion, is engaging in activity that could harm our infrastructure, other customers, or the integrity of our platform. In such cases, no refund will be issued.

  • Any activity that compromises or could compromise the security of our infrastructure will result in immediate termination without refund
  • Any activity that degrades service for other customers will result in termination without refund
  • Attempting to exploit, reverse-engineer, or circumvent our platform's security measures will result in termination without refund
  • Using the service for illegal purposes, distributing malware, or facilitating harmful activities will result in termination without refund
  • Excessive resource consumption beyond your plan's fair-use limits will result in termination without refund
  • Our determination of what constitutes abuse is final and not subject to appeal

Chargebacks and Disputes

If you initiate a chargeback or payment dispute with your bank or credit card company instead of contacting us, we reserve the right to take the following actions:

  • Your account will be immediately and permanently suspended
  • All data associated with your account will be deleted
  • You will be permanently banned from creating new accounts
  • We will contest all chargebacks with evidence of service delivery
  • We reserve the right to pursue recovery of the disputed amount plus administrative costs

Third-Party API Keys and Services

Our platform requires you to provide your own API keys from third-party providers (such as Anthropic, OpenAI, or others). We are not responsible for any costs, errors, or issues arising from your use of these third-party services.

  • We are not responsible for charges incurred on your third-party API accounts
  • If your API key is invalid, expired, or rate-limited, that is not a service failure on our part
  • We encrypt your API keys at rest but are not liable for unauthorized use if your account credentials are compromised due to your negligence
  • Switching API providers or encountering compatibility issues with specific providers is not grounds for a refund

Service Availability and Uptime

We strive to maintain 99.9% uptime for our services. However, we do not guarantee uninterrupted service. Maintenance windows may occur with notice when possible.

  • We may perform scheduled maintenance with notice
  • Emergency maintenance may occur without notice
  • Force majeure events are excluded from liability
  • Service may be temporarily unavailable due to technical issues

Limitation of Liability

To the maximum extent permitted by law, Molted Cloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service.

  • Our total liability is limited to fees paid in the last 12 months
  • We are not liable for data loss or corruption
  • We are not liable for third-party service failures
  • We are not liable for content generated by your instances

Termination of Service

Either party may terminate the service agreement at any time. Your subscription will remain active through the end of your current billing period. Upon termination, your instances will be deleted and data will not be recoverable.

  • You may cancel your subscription at any time from your Dashboard
  • We may terminate accounts violating our policies
  • Your instance remains active until the end of your current billing period
  • Data is deleted 30 days after account termination and cannot be recovered
  • If you want to keep your data, export it before your instance is stopped

Changes to Terms

We reserve the right to modify these terms at any time. Your continued use of the service following any changes constitutes your acceptance of the new terms. We will provide notice of material changes via email.
